Nexus IP FIrm incorrect representations and filing
The assigned attorney, Kyle Aarons, is a California licensed attorney. However, the California Bar states he is not in California, as claimed. Further, he is not an attorney listed by the USTPO.
Because the name to be registered is already being used in commerce by the client, a different filing was required than that submitted. The filing has to now be withdrawn.
The actual filing lists yet annother attorney, actually located in New York, with a false e-mail address to yet another organization.
Subsequent counsel advises that because the filing is both incorrect and appears to be fraudulent, the application must be withdrawn and the process again started.
Mr. Aarons declined to provide a receipt showing a payment made to the UPTO.
The charge was not through Nexus IP Firm, but through Media Designs, in Naperville, FL, 855-316-2884, digitmediadesigns.com.
Mr. Aarons declined in writing to refund fees when the deficiencies and false attorney information was pointed out.
