Terrible experience as a landlord

Terrible experience as a landlord. Mis-sold by our management company, this is anything but fair.

Still in the process of repairing house from significant damages by tenants. Having claimed 3840gbp with total repairs costs now exceeding 6000gbp and a lot of time. Flatfair refused any discussion or appropriate appeal. There was a simple adjudication on the basis of fair wear and tear with a landlord not entitled to betterment and a final 1346gbp award upheld with no further rights as we had been duped into their t&C's.

My house was significantly damaged by a tenancy agreed to four people living there. They treated the property as a hmo for multi-generational living and invited their wider family to stay. During the tenancy we had to pay a huge sums after they blocked the sewerage with baby wet wipes and flooded the downstairs apartment forcing our Ukrainian refugee to leave. They also stopped paying their rent. This we could not claim through flatfair at all.

There was a checkout report for all the other damages and very obvious photo evidence on everything. Flatfair negated everything. I had a cracked bath that needed replacing from a dropped shower head. Broken windows from forcing the mechanism. Holes in walls. Stickers on walls. Holes in carpet. Damaged fridge. Different paint used to cover up splattered on almost every wall and drilled holes poorly filled in. It took a massive and costly redecoration. The list goes on.

Terrible system heavily weighted to tenants and excuses the management company from any liability. Avoid. Intermediary companies like this have no right to exist, management company should do their job.

Flatfair will try to get this review taken down or refute it as they clearly do not want to support an aggrieved landlord in any way.

UPDATE: So Flatfair did to refute it. Damola, you have confirmed you used the wrong bath when assessing the report. There was a stone bath (ours) and a plastic bath (with taps) on the seller detail the management company sent you. A small amount of attention in comparing the checkout report (crack in stone bath) to the detail sent to you on a replacement stone bath would have made this obvious to you. It is simple competence in a job like this. We never claimed for taps, simply the stone bath. You have assumed this and then subtracted from the cost of the plastic bath!

And by the way, we searched hard to find a discounted stone bath so we were 'fair' to the tenants. A pity you could not be fair to us. What this tells me, is that you agreed in the compensation for the bath. You just used the wrong one and then you discounted that further for the cost of taps we did not claim. It would be good for your company to own up to this mistake and live up to your 'fair' tag. But you will not, because you will always have a bias to the tenant in a country that continues to demonise landlords.

Thank you for your review. I’m sorry to hear how strongly you feel about the outcome, and I do understand that dealing with end-of-tenancy damage can be stressful and time-consuming.

We have reviewed flatfair reference 74316. The claim submitted for adjudication was £3,890, and the adjudicator awarded £1,346.49. This was not a blanket rejection of the claim. The award included £384 towards the damaged bath and £962.49 towards cleaning, window cleaning, appliance cleaning, garden tidying, stair carpet damage, décor issues, carpet protectors, microwave surround repair, toilet roll holder repair and replacement light bulbs.

The reason the full amount claimed was not awarded was not because flatfair ignored the evidence. The adjudicator had to apply the same core principles that apply in a traditional deposit dispute: the landlord must evidence the condition at the start and end of the tenancy, prove the tenant’s liability, evidence the cost claimed, allow for fair wear and tear, and avoid betterment.

For example, the bath claim was made for £1,890. The evidence included a lower cost of £640 for the supply of a bath and taps, alongside a higher internet example, but it was not clear why the higher figure should be used. The check-in report also recorded that the bath was already scratched at the start of the tenancy, although no crack was recorded. The adjudicator therefore accepted that damage had occurred during the tenancy, but awarded 60% of the evidenced lower cost rather than the full replacement amount.

For the wider £2,000 claim, the adjudicator accepted a number of items and made an award. However, the full amount was not awarded because the costs were not individually itemised for each issue, the evidence submitted did not clearly support the full £2,000 claimed, and some matters were not sufficiently identified in the check-out report. On cleaning, the adjudicator also had to consider that the check-in report recorded the property as being in the process of being cleaned, but the final standard achieved at the start of the tenancy was not clearly evidenced. That meant a full deep-clean award could not fairly be made.

We appreciate that you say your overall repair costs were higher than the award. However, adjudication can only award compensation for the charges submitted, evidenced and proven within the process. It cannot simply reimburse all later repair or refurbishment costs where those costs go beyond what the evidence supports, or where the legal principles of fair wear and tear and betterment require a reduction.

We would not seek to remove a review simply because it is critical. We do, however, think it is important to clarify that the claim was assessed through an evidence-based adjudication process, and that an award was made where the evidence supported it.
